中江县国有建设用地使用权政府收储(收购)实施办法(修订)

 

为优化土地资源配置,加强土地调控,促进土地资源合理利用,进一步完善土地储备制度,提高建设用地保障能力,根据《中华人民共和国土地管理法》《中华人民共和国城市房地产管理法》《土地储备管理办法》《德阳市中心城区国有建设用地使用权政府收购实施程序》等法律法规和政策文件规定,结合我县实际,制定本实施办法。

一、收购计划

每年年底至次年2月底前由中江县土地储备中心结合城市发展需要,对适宜收购、整体开发的地块进行前期调查摸底,将符合条件的国有建设用地使用权收购计划报县自然资源局。县自然资源局会同中江高新区、经科、财政、住建、生态环境等部门进行初步审查,初审后的收购计划由县自然资源局于3月底前报县人民政府审定。

土地收购工作原则上按照收购计划推进实施。根据实际情况,确需调整的,应报县人民政府审批后实施。

二、收购范围

原土地使用权人主动申请收购的土地;符合条件的闲置、空闲和低效利用需纳入收购、收回、置换的国有建设用地;可行使优先购买权取得的土地;县人民政府指定的其他需要进行收购的土地。

存在违法占地、违法建设、土壤污染、文物遗存、矿产压覆、洪涝隐患、地质灾害风险等情况的土地,在按照有关规定由相关单位完成核查、评估、治理和处理之前,不得收购。

对取得方式以及程序不合规、土地权属不清晰、应办理相关不动产登记手续而未办理的土地,在依法依规处理前,不得收购。

三、收购程序

(一)土地使用权人提出申请。原土地使用权人向县土地储备中心提出申请并准备以下资料:

1.权属主体资料:个人身份证、单位营业执照、法人代表人证明、授权委托书等;

2.权属证明文件:不动产权证书(国有土地使用证)、房屋所有权证(房屋使用权证明),土地和地上建筑物及构筑物无争议、无抵押、无法院查封等他项权利限制声明;

3.地形现状图(或宗地图);

4.拟收购的资产属国有资产的,需提交国资管理部门同意收购的意见。

(二)权属和规划用途核实。由县土地储备中心会同有关部门对原土地使用权人提供的土地和地上建(构)筑物的权属、土地及地上建(构)筑物面积、设施设备、土地用途、土地四至范围、抵押等情况进行实际调查和核实。由县土地储备中心通过公开招标方式确定测绘机构根据有关技术规范对拟收购的土地及地上建(构)筑物面积进行实地勘测并形成书面测绘报告(测绘费用由县土地储备中心承担)。面积、权属等核实后,由县土地储备中心向县自然资源局核实拟收购地块的规划用途。

(三)土地会审。依据测绘结果和核实情况,由县土地储备中心会同自然资源(规划、用地、法规)、中江高新区、财政、住建、执法、司法、经科等有关部门和所涉乡镇研究收购相关事宜。

1.对于涉及闲置土地的,严格履行闲置土地责任认定程序,厘清政府、用地单位责任,并按照《闲置土地处置办法》之规定执行。

2.对于涉及无产权建筑的,应按照实事求是、依法合规的原则,建立相关部门共同参与的论证处理机制,对涉嫌违法建筑,应当移送相关部门对违法建筑依法处理后,再实施收购。

3.对拟收回的土地使用权从事过有色和黑色金属矿采选、有色和黑色金属冶炼、石油和天然气开采、石油加工、化学原料和化学品制造、化学制药、铅蓄电池、焦化、电镀、制革、汽车制造、电子拆解、垃圾焚烧等行业生产经营活动,和从事过危险废物贮存、利用、处置活动的建设用地,以及用途变更为住宅、公共管理与公共服务用地的上述用地,由原土地使用权人按照国家发布的建设用地土壤环境调查评估技术规定,开展土壤环境状况调查评估,按程序向生态环境主管部门备案,并将评估结果和备案情况报县土地储备中心存档。未进行土壤环境调查,未经治理修复或治理修复不符合相关标准的疑似污染地块和污染地块,不得进行相关地块的收回、收购或供应。

4.对于《国有土地使用证》载明为综合用地生产、办公用地,但没有注明各类具体用途及其所占的面积比例的应本着尊重现状、实事求是的原则确定具体用途及其所占的面积比例,具体办法如下:

1)对于登记用途不规范的,应按县人民政府批文批准用途、土地出让合同载明用途、办理国有土地使用证(不动产登记证书)载明用途、缴纳土地出让金标准等四个方面进行综合核查并认定用途、比例。

2)对于县人民政府批文等已明确为商服综合用地或商住综合用地的,应按照商服或商住用地确定其土地用途。

3对于证载为综合用地或生产、办公用地,且县人民政府批文等未明确为商服综合用地或商住综合用地的,其土地用途确认时可以简化为生产性用地、非生产性用地两大类,生产性用地为直接用于生产或生产配套的工业厂房等建筑物的用地,收购时按照工业用地确定用途及面积;非生产性用地为企业办公、职工宿舍、倒班房等为工业企业配套的附属设施占地,收购时参照办公用地确定用途及面积。具体认定时应通过已办理的房产证认定的房屋用途与实地核查建筑物实际用途两种方式相结合来认定具体土地用途及其土地所占的面积比例,对于已办理房产证并认定房屋用途的房屋所占土地,按照房屋办证用途认定所占土地用途;对未办理房产证或虽办理房产证但未确定房屋用途的,原则上按实际的房屋使用用途认定土地用途。对于未修建房屋的土地,本着基本公平和协商一致的原则,可按照生产性、非生产性用途平摊的方式予以确认面积。鉴于工业企业所用土地的主要用途是生产性用地,企业的非生产性用地面积认定比例原则上不得超过总用地面积的50%

(四)评估测算。由县土地储备中心通过公开招标方式确定评估机构,根据会审意见,由评估机构按照不动产权证书(或国有土地使用证)登记用途,对拟收购的房地产及设施设备等依据相关评估技术规范进行价值预评估,并出具评估报告。 (五)复核和备案县土地储备中心在德阳市自然资源和规划局评估机构备案系统内抽取评估机构对评估报告进行复核(复核费用由县土地储备中心承担),其中国有资产占有单位涉及县属国有资产的评估报告,由县土地储备中心将评估报告送国资部门备案。

(六)补偿协商。由县土地储备中心与原土地使用权人进行协商,确定土地的补偿价格、收购时间、付款方式、标的交付等内容,协商一致后由县土地储备中心拟定收购方案。

(七)价格确认。县土地储备中心根据与原土地使用权人对收购价格的协商结果,将收购方案分别报送县自然资源局、县财政局确认。

(八)政府审批土地收购方案报县人民政府审批。收购方案应包括:

1.基本情况。土地面积、建筑面积、原土地使用权人、位置、原批准用途、现规划用途、已使用年限、剩余使用年限等;

2.评估情况;

3.收购补偿费用及其支付方式和期限;

4.交付土地的方式和期限;

5.县自然资源局、县财政局确认情况;

6.其他需要说明的事项。

土地收购方案应当附国有土地使用权收购协议(草案)。

(九)签订正式协议。收购方案经县人民政府批准后,县土地储备中心与原土地使用权人签订《国有土地使用权收购协议》,并完善相关手续。

(十)注销权属登记。依据县人民政府收购批复注销原权属单位(个人)不动产权证书(或国有土地使用证、房屋产权证书)。

(十一)支付收购补偿费用。土地储备中心根据《国有土地使用权收购协议》约定的期限、数额和方式,向原土地使用权人支付相关收购补偿费用。

(十二)交付标的。根据《国有土地使用权收购协议》约定的期限和方式,原土地使用权人向县土地储备中心交付被收购的土地和建筑物(附着物)及其他设施。

(十三)纳入土地储备库。收购土地按相关要求录入土地储备库。

(十四)开发利用。由县土地储备中心对收购土地进行前期平整、管护、临时利用,完善土地出让前期准备工作。

四、其他

本办法自202318日施行,有效期3年。如在施行期间,上级出台新法规或政策另有规定,从其规定。
